Terms of Use

Welcome to Nivaala! These Terms of Use ("Terms") constitute a legally binding agreement between you and Nivaala (OPC) Private Limited ("Nivaala", "we", "us", or "our") governing your access to and use of the Nivaala mobile application and associated services ("Platform"). This is an electronic record under the Information Technology Act, 2000 and does not require a physical or digital signature.


Please read these Terms carefully. By accessing or using the Platform, you agree to be bound by these Terms and our Privacy Policy (available at https://www.nivaala.co/policies/privacy-policy). IF YOU DO NOT AGREE TO THESE TERMS, YOU ARE NOT ENTITLED TO USE THE PLATFORM AND ANY FURTHER USE SHALL BE UNAUTHORISED.


1.  Description of Service

Nivaala is India’s first voice-first food heritage preservation platform. We help families record, preserve, and share heirloom recipes using voice recordings, text, and photographs, across 20+ Indian languages. The Platform enables users to build a personal family recipe archive, collaborate with family members through Family Circles, and optionally contribute recipes to the Food Atlas, a community-built map of Indian culinary traditions. Nivaala also offers associated physical products and services, including handcrafted Recipe Keeper journals, bespoke family cookbook publishing, and community experiences.


2.  User Eligibility

The Platform is intended for individuals who are 18 years of age or older. If you are under 18, you may access and use the Platform only under the supervision of a parent or guardian who has accepted these Terms, registered on the Platform, and takes full responsibility for your use of the account.


3.  Free Access

The Platform is currently available free of charge. Nivaala reserves the right to introduce paid features or subscription tiers in the future, with reasonable prior notice to users.


4.  Ownership of Recipes and Content


4.1  Your Ownership

You retain ownership of all content you submit to the Platform, including recipes, audio recordings, photographs, and written text ("User Content"), unless such content was already in the public domain at the time of submission.


4.2  Licence Granted to Nivaala

By submitting User Content to the Platform, you grant Nivaala a worldwide, non-exclusive, sub-licensable, transferable, royalty-free licence to use, reproduce, store, display, distribute, adapt, and create derivative works from your User Content for the following purposes:

  • Operating and improving the Platform and its features;

  • Displaying your recipes within your personal archive and Family Circles;

  • Displaying publicly shared recipes on the Food Atlas, where you have given explicit consent to do so;

  • Generating anonymised, aggregated insights about Indian food culture and culinary traditions for research, product development, and Nivaala’s cultural preservation mission.


This licence does not permit Nivaala to sell your identifiable personal recipes to third parties or use your name in any commercial promotion without your separate consent.


4.3  Anonymised and Aggregated Data

Nivaala may use anonymised, aggregated, and non-identifiable data derived from User Content — including recipe patterns, ingredients, regional culinary trends, and linguistic data — for internal research, product development, cultural documentation, and business purposes. This data will not identify you personally and is not subject to the ownership provisions above. This is how Nivaala builds and maintains the Food Atlas as a living record of Indian food heritage.


4.4  Food Atlas and Public Sharing

Recipes are private by default and visible only to you and members of your Family Circles. If you choose to publish a recipe to the Food Atlas, it will become publicly visible on the map, associated with the city or region you specify. You may unpublish a recipe at any time, after which it will be removed from the Food Atlas. Nivaala’s right to use anonymised, aggregated insights derived from previously published recipes is not affected by unpublishing.


4.5  Your Responsibilities

By submitting User Content, you represent and warrant that your content:

  • Is your original creation or you have obtained all necessary permissions from the rightful owner;

  • Does not infringe any copyright, trademark, patent, or other intellectual property right of any third party;

  • Is not defamatory, obscene, pornographic, paedophilic, harassing, or otherwise unlawful;

  • Does not violate any applicable law or regulation in force in India or any other jurisdiction;

  • Does not contain false, misleading, or deceptive information;

  • Does not impersonate any person or entity;

  • Does not contain software viruses or malicious code of any kind;

  • Does not threaten national security, sovereignty, or public order;

  • Is not harmful to minors in any way.


5.  Termination of Service

Nivaala reserves the right to suspend, restrict, or terminate your account or access to the Platform at any time, with or without notice, if Nivaala determines in its sole discretion that you have breached these Terms, violated applicable law, engaged in inappropriate conduct, or provided false information. You agree that Nivaala shall not be liable to you for any such action.


6.  Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NIVAALA SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE PLATFORM OR ANY CONTENT THEREON. NIVAALA’S TOTAL MONETARY LIABILITY TO YOU SHALL NOT EXCEED INR 1,000. IN JURISDICTIONS WHERE SUCH LIMITATIONS ARE NOT PERMITTED, NIVAALA’S LIABILITY SHALL BE LIMITED TO THE EXTENT PERMITTED BY LAW.


7.  Content Removal and Account Deletion

You may delete individual recipes or your entire account at any time through the Platform. Upon deletion, your personal recipes and account data will be removed from the Platform and will no longer be accessible to you or other users. Nivaala’s right to retain and use anonymised, aggregated insights already derived from your content prior to deletion is not affected by account deletion.


8.  Modifications to These Terms

Nivaala reserves the right to update or revise these Terms at any time. Revised Terms will be posted on the Platform and will take effect immediately upon posting. We recommend you review these Terms periodically. Your continued use of the Platform after any revision constitutes your acceptance of the updated Terms.


9.  Governing Law and Jurisdiction

These Terms are governed by the laws of India. Nivaala may bring proceedings before any court of competent jurisdiction. Any proceedings brought by you shall be exclusively before the courts at New Delhi, India.

11.  Survival

The clauses relating to ownership, licence grants, limitation of liability, governing law, and grievance redressal shall survive the termination of these Terms and your use of the Platform.


12.  Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Nivaala governing your use of the Platform and supersede all prior agreements between the parties in relation thereto. Your acceptance of these Terms constitutes a valid and binding agreement. Any applicable stamp duty shall be borne by you.
